Ex-King Constantine wins property battle in European Court

Strasbourg - Ex-King Constantine of Greece won a six-year legal battle against the Greek government when the European Court of Human Rights ruled on Thursday that the confiscation of his property was a violation of human rights.

The court in Strasbourg ruled that a 1994 Greek law authorising the seizure of several estates infringed the European Convention of Human Rights, specifically a protocol declaring that every citizen is "entitled to the peaceful enjoyment of his possessions". The ruling stated, "The court was of the opinion that the lack of compensation for the deprivation of the applicants' property upset, to the detriment of the applicants, the fair balance between the protection of property and the requirements of public interest."

The 60-year-old Constantine, who currently lives in exile in London, his sister Princess Irene and his aunt Princess Ekaterini had filed suit in Strasbourg after Greek courts turned down their appeals. The Strasbourg court did not rule on Constantine's claim for 1.4 billion pounds (989 million dollars) in compensation in case the property is not returned. Greek Deputy Foreign Minister Elisabeth Papazoi said Athens will honour the decision but first would examine the issue of compensation. "We will honour the decision of the European Court," said Papazoi, "but the former king has never paid taxes to the Greek state, so in fact the amount owed by the family in back taxes may be more than what he will be awarded in compensation. It may turn out that the former king owes Greece money rather than the other way around," she added. The monarchy was overthrown in Greece in 1974. Constantine lodged the case with the European Court after his appeals to have the property returned were rejected in Greek courts.

The Greek government argues that the property, which includes a country estate at Tatoi outside Athens, the Mon Repos place on the island of Corfu and the Polidendri forest estate in the foothills of Mount Olympus had never belonged to the royal family but were placed at their disposal by the state. The court said it would examine the issue of compensation at a later date.
